Terms and Conditions for the supply of Artworks

This page (together with our Privacy Policy) tells you information about me and the legal terms and conditions (Terms) on which I sell any of the artworks (Artworks) listed on my website (my site) to you.

These Terms will apply to any contract between us for the sale of Artworks to you (Contract). Please read these Terms carefully and make sure that you understand them, before ordering any Artworks from this site.
​
You should print a copy of these Terms or save them to your computer for future reference.
​
These Terms may be reviewed from time to time as set out in clause 7. Every time you wish to order Artworks, please check these Terms to ensure you understand the terms which will apply at that time. These Terms were most recently updated on 26th July 2020.

These Terms, and any Contract between us, are only in the English language.

1.          Information about me
1.1Â Â Â Â Â Â Â Â Â The artist who creates the Artworks and who operates the website NicholaCampbell.Art

2.           My Artworks
2.1         The images of the artworks are for illustrative purposes only but I have made every effort to display the Artworks accurately, I cannot  guarantee that your computer's display reflects the Artworks accurately. My Artworks may vary slightly from those images.

3.                  How I use your personal information
I only use your personal information in accordance with my Privacy Policy. Â Please take the time to read our Privacy Policy, as it includes important terms which apply to you.
3.1Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â You acknowledge that in entering into this Contract you do not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in these Terms or any document expressly referred to in them or our Privacy Policy, Terms of Website Use and Website Acceptable Use Policy.
3.2Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â You and I agree that neither of us shall have any claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this Contract.

4.                  How the contract is formed between you and I
4.1Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â My online shopping pages will guide you through the steps you need to take to place an order with me. My order process allows you to check and amend any errors before submitting your order. Please take the time to read and check your order at each page of the order process.
4.2               After you place an order, you will receive an e-mail from me acknowledging that I have received your order. However, please note that this does not mean that your order has been accepted. Our acceptance of your order will take place as described in clause 6.3.
4.3               I will confirm our acceptance to you by sending you an e-mail that confirms that the Artworks have been dispatched (Dispatch Confirmation). The Contract between us will only be formed when I send you the Dispatch Confirmation.
4.4Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â If I am unable to supply you with an Artwork, for example because it is not in stock or no longer available or because I cannot meet your requested delivery date or because of an error in the price on our site as referred to in clause 7.4, I will inform you of this by e-mail and I will not process your order. If you have already paid for the Artworks, I will refund you the full amount including any delivery costs charged as soon as possible.

5.                  Our right to vary these Terms
5.1Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â I may amend these Terms from time to time. Please look at the top of this page to see when these Terms were last updated and which Terms were changed.
5.2Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Every time you order Artworks from me, the Terms in force at the time of your order will apply to the Contract between you and me.
5.3               If I have to revise these Terms as they apply to your order, I will contact you to give you reasonable advance notice of the changes and let you know how to cancel both the Contract and any Artworks which have been ordered further to these Terms if you are not happy with the changes. You may cancel either in respect of all the Artworks or just the Artworks you are yet to receive.

6.                  CANCELLATION and returns
6.1Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â If you cancel and/or return any Artwork, I have a no quibble returns policy in which you may return (at your cost) any relevant Artwork(s) you have already received. I will arrange a full refund of the price you have paid, as long as the Artwork has been returned in the exact same condition as you received it.

7.                  Delivery
7.1Â Â Â Â Â Â Â Â Â Â We will contact you with an estimated delivery date if it is anything different from 3-5 working days, which will advised in the Dispatch Confirmation (the date on which we e-mail you to confirm our acceptance of your order). Occasionally my delivery to you may be affected by an Event Outside Our Control.

8.0Â Â Â Â Â Â Â Â Â Returns
8.1Â Â Â Â Â Â Â Â Â Any Artwork which is returned to me must be returned to me within 14 days of receipt by you, in the same protective packaging or in similiarly protective packaging.
8.1Â Â Â Â If the Artwork is faulty in anyway, I will be fully entitled to inspect any Artwork in order to ascertain both the nature and extent of the fault, or not, as described by you and you will be refunded the price paid for the Artwork together with any carriage costs incurred in returning the Artwork to me.
8.2Â Â Â If the Artwork is one which cannot be returned to me by ordinary post, we estimate that if you use the carrier which delivered the Artwork to you, these costs should not exceed the sums I charged you for delivery (non-UK orders). If I have offered to collect the Artwork from you, I will charge you the direct cost to me of collection. I will advise of the charge at the point of enquiry.

9.                  Events outside our control
I will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract that is caused by an Event Outside Our Control. An Event Outside Our Control is defined below in clause 16.2.Â
9.1Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â An Event Outside Our Control means any act or event beyond our reasonable control[, including without limitation strikes, lock-outs or other industrial action by third parties, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster, or failure of public or private telecommunications networks or impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport.
9.2Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract:
(a)Â Â Â Â Â Â Â Â Â Â Â we will contact you as soon as reasonably possible to notify you; and
(b)Â Â Â Â Â Â Â Â Â Â Â our obligations under a Contract will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
9.3Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â You may cancel a Contract affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact me. If you opt to cancel, you will have to return (at your cost) any relevant Products you have already received and I will refund the price you have paid, including any delivery charges.
9.4Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Deliveries of Artworks will be tracked and/or need to be signed for.
9.5Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â Delivery of an Order shall be completed when I deliver the Artworks to the address you gave me or you or a carrier organised by you collect them from me and the Artworks will be your responsibility from that time.
9.6Â Â Â Â Â Â Â Â Â Â Â Â Â Â Â You own the Artworks once I have received payment in full, including all applicable delivery charges.

10.               International delivery
10.1Â Â Â Â Â Â Â Â Â Â Â Â I am very happy to quote for delivering Artwork to addresses outside the UK.
10.2Â Â Â Â Â Â Â Â Â Â Â Â You may place an order for Artworks from outside the UK, but this order must be for delivery to an address in the UK.

11.               Price of Artworks and delivery charges
11.1Â Â Â Â Â Â Â Â Â Â Â Â The price of the Artwork will be as quoted on the website at the time you submit your order. I take all reasonable care to ensure that the are correct however please see clause 11.5 for what happens if we discover an error in the price of an Artwork you ordered.
11.2Â Â Â Â Â Â Â Â Â Â Â Â Prices of Artwork may change from time to time, but changes will not affect any order you have already placed.
11.3Â Â Â Â Â Â Â Â Â Â Â Â The price of a Artwork is inclusive of standard delivery charges within UK mainland. Next day delivery service or delivery outside UK mainland can be arranged and will be quoted separately.

12.               How to pay
12.1Â Â Â Â Â Â Â Â Â Â Â Â You can pay for Artworks using a debit card/ credit card.
12.2Â Â Â Â Â Â Â Â Â Â Â Â Payment for the Artworks and all applicable delivery charges is in advance.

13.               Artist guarantees
13.1            My Artworks have been made quality materials, including light-fast inks and giclée prints.
13.2Â Â Â Â Â Â Â Â Â Â Â Â I do not recommend any of my Artworks, originals or prints are displayed in direct sunlight.
